Court told man blacked out because of an old head injury

A man who claimed he blacked out on the forecourt of a Greystones petrol station because of an old head injury had charges against him dismissed at Bray District Court last Friday.

Garda David Brady told the court that he arrested Anthony O'Toole, 5 New Road, Killincarrig, Greystones, on February 19 last after finding him in an extremely drunken state on February 19 last at the Statoil garage on Kilcoole Main Street.

The garda said that O'Toole was unable to stand and was falling about on the forecourt.

He was conveyed to Greystones garda station, where he was falling in and out of consciousness.

The ambulance crew arrived and had to put a tube in his lung to maintain an airway before taking him to hospital.

O'Toole told the court that he believes he suffered a seizure on the night in question caused by an old head injury.

He said that he had a few pints and got on the bus, but blacked out when he got as far as Windgates.

Judge Murrough Connellan dismissed the public drunkeness charge with the benefit of the Probation Act.
